Essay About Harry Potter At the beginning of the book, Harry Potter, Harry is living with his aunt and uncle. Life is not very good there. Harry's parents were killed when he was just a baby, and Harry longs to find out why. A couple of days before Harry's eleventh birthday he started getting letters in the mail, but he was not allowed to read them. Uncle Vernon made sure of that. But these letters started coming rapidly, no matter what the family tried, they kept coming in. Uncle Vernon went so crazy over these letters that they were forced to leave the house, they were taken to this old, wet, moldy shack in the middle of nowhere. Harry is counting down to his eleventh birthday, five, four, three, two, one… BOOM someone bursts right into the old moldy shack. Vernon has a gun and Dudley is scared for his life. The giant whose name is Hagrid explains to Harry how he is a wizard and his parents were killed when he was little. Hagrid told him he was a wizard and that he was accepted into Hogwarts. Uncle Vernon was not thrilled and said Harry was going nowhere. Anyway, Harry was given the information and needed to go to platform nine and three quarters which is where he went, but something strange was going on, there was no platform nine and three quarters. No one knew about this platform until he saw a family so he asked and she said you have to run right in between two platforms. So he did. Harry was now on his way to Hogwarts. Wow, was Harry popular, everyone knew about him, Harry was confused. Harry now heard about a sorting hat that you need to take a test for. Harry was very scared for this test because he didn't know anything about being a wizard at all but little did he know it was no test for him, it was a test for the teachers to see which house Harry will be in Harry ended up being in the house of Gryffindor with the smart girl Hermione and someone he met on the train named Ron. One of his teachers, Snape was so mean, he despised Harry and was never happy. One day during a flying class on brooms with professor McGonagall someone started early and had to go to the doctor wing and everyone was told not to fly and stay there. Of course, Malfoy had to get Harry upset so they started flying. Harry was so good and when the professor came back she saw, she made it seem like he was in trouble but he ended up being the seeker of the quidditch team. Harry and his friends were always up to some kind of interesting risky task such as when there was a goblin in the girl's bathroom and Ron and Harry saved Hermione. Or when Hagrid bought a dragon that could definitely not stay at Hogwarts so they had to get the dragon out with no one seeing. But one of the most important things the three of them were up to was stopping who they thought on one night that Snape was plotting to. Harry, Hermione, and Ron knew this would be difficult and it was. Especially for Harry. The three kids had to go through many obstacles, when it was just Harry, Quirrel was there. Harry probably thought he was safe but it turns out Quirrel is the one working for Voldemort and he is sharing a body with Voldemort. Quirrel needed that stone so he tied Harry up. Then Voldemort told him that the boy is the answer and to have Harry look in the mirror. Little did they know, Harry had the stone in his pocket. When Quirrell took off his turban there was an evil-looking sideman. Harry now ran and Voldemort told Quirrel to kill him, but he just couldn't, Harry felt so much pain in his head, he blacked out. When Harry Woke up he was in the hospital. Dumbeldore was there Harry talked about what had happened and Dumbeldore told him how Voldemort did not get the stone and how he is not dead but is looking for another body to share. Dumbledore told him How there is going to be an end-of-the-year festival tonight and if he is feeling up to it he would love to have him there. When Hagrid visited he broke into tears because he thought it was all his fault. Later that day when he went to the festival obviously Slytherin won, there were balloons their color and a big banner. But when dumbledore added up extra points Gryffindor ended up winning for how much they helped Hogwarts! The day everyone goes back home Harry of course must go back home to Mr & Mrs. Dursley’s house. Life is normal, until next year.

Top exam tips from Hogwarts students and professors

Revise, revise, revise… and revise some more.

We think it’s pretty easy to guess who might give this tip… the one and only Hermione Granger. When it came to exams, nobody worked harder than her. Even when she was a first-year, she took exams seriously. So, we think Hermione would tell you that revision is key. If you fail to prepare, well… prepare to fail. So hit those books and you should do just fine.

Hermione, however, had more on her mind than the Philosopher’s Stone. She had started drawing up revision timetables and colour-coding all her notes. Harry and Ron wouldn’t have minded, but she kept nagging them to do the same. ‘Hermione, the exams are ages away.’ ‘Ten weeks,’ Hermione snapped. ‘That’s not ages, that’s like a second to Nicolas Flamel.’ ‘But we’re not six hundred years old,’ Ron reminded her. ‘Anyway, what are you revising for, you already know it all.’ ‘What am I revising for? Are you mad? You realise we need to pass these exams to get into the second year? They’re very important, I should have started studying a month ago, I don’t know what’s got into me...’ Harry Potter and the Philosopher’s Stone

Hermione sat on a bench in the Great Hall. She has a book open on her lap and is smiling.

In this image:

Take it easy… don’t stress too much

Harry and Ron’s approach to revision was rather different to Hermione’s. They took a more… shall we say… laidback approach. If you were to ask them for their tips on how to survive your exams, we think they might just mention the importance of taking a break every once in a while. It is what they did in their O.W.L.s after all.

On Friday, Harry and Ron had a day off while Hermione sat her Ancient Runes exam, and as they had the whole weekend in front of them they permitted themselves a break from revision. They stretched and yawned beside the open window, through which warm summer air was wafting as they played wizard chess. Harry Potter and the Order of the Phoenix

Malfoy would say it’s about who you know

Now, we’re not advocating this an effective method for passing tests, but if you were to ask this resourceful Slytherin about how to get through exams, he’d probably tell you about this supposed loophole. Malfoys don’t need to worry about silly schoolwork when their connections will get them through life – or so they say – whether Draco was bluffing is an entirely different matter (and we suspect he was).

‘Of course, it’s not what you know,’ he was heard to tell Crabbe and Goyle loudly outside Potions a few days before the exams were to start, ‘it’s who you know. Now, Father’s been friendly with the head of the Wizarding Examinations Authority for years – old Griselda Marchbanks – we’ve had her round for dinner and everything…’ Harry Potter and the Order of the Phoenix

A close up image of Draco Malfoy looking concerned.

Remember to have a little confidence in yourself

This is important. You’re never going to get through your exams if you don’t believe you can. We all know one Gryffindor that was prone to a little – or a lot – of self-doubt, Neville. Even though he didn’t think he could get through his O.W.L. exams, his professors did as McGonagall reminded him…

‘You cannot pass an O.W.L.,’ said Professor McGonagall grimly, ‘without serious application, practice and study. I see no reason why everybody in this class should not achieve an O.W.L. in Transfiguration as long as they put in the work.’ Neville made a sad little disbelieving noise. ‘Yes, you too, Longbottom,’ said Professor McGonagall. ‘There’s nothing wrong with your work except lack of confidence.’ Harry Potter and the Order of the Phoenix

Neville Longbottom is sitting in a chair and smiling

Snape would probably say a little fear can be very useful…

This tip is slightly controversial, and we don’t approve of the use of humiliation and fear as a tactic. However, there is no doubt Snape’s particular brand of… encouragement was effective. Harry was motivated by the Potions master’s harsh marking and was determined to prove him wrong.

‘The general standard of this homework was abysmal. Most of you would have failed had this been your examination. I expect to see a great deal more effort for this week’s essay on the various varieties of venom antidotes, or I shall have to start handing out detentions to those dunces who get a “D”.’ He smirked as Malfoy sniggered and said in a carrying whisper, ‘Some people got a “D”? Ha!’ Harry realised that Hermione was looking sideways to see what grade he had received; he slid his moonstone essay back into his bag as quickly as possible, feeling that he would rather keep that information private. Determined not to give Snape an excuse to fail him this lesson, Harry read and reread every line of instructions on the blackboard at least three times before acting on them. His Strengthening Solution was not precisely the clear turquoise shade of Hermione’s but it was at least blue rather than pink, like Neville’s, and he delivered a flask of it to Snape’s desk at the end of the lesson with a feeling of mingled defiance and relief. Ernie would think there is no harm in a little competition…

Hufflepuffs might not be known for their competitive natures, but Ernie Macmillan certainly had that streak in him. His plan seemed to be the student who put in the most hours of revision overall. Whether he was really in competition with himself or his peers we’re not sure, but hey, if it works it works!

‘I’m doing eight,’ said Ernie, puffing out his chest. ‘Eight or nine. I’m getting an hour in before breakfast every day. Eight’s my average. I can do ten on a good weekend day. I did nine and a half on Monday. Not so good on Tuesday – only seven and a quarter. Then on Wednesday –’ Harry Potter and the Order of the Phoenix

Professor McGonagall sat at the teachers' table in the Great Hall looking to her left

Surprisingly, you might find McGonagall thinks there is more to life than exams

Yes, tests are important – we’re not arguing with that – but they’re not everything. There is more to life than exams and working hard and revision (even if Hermione might disagree). It’s important to keep things in perspective and to know when to prioritise – as the Hogwarts professors decided once the threat of the Basilisk was no more.

If you don't know who this fellow is (that's Ralph Fiennes playing him), you can find out in the Harry Potter vocabulary below. He's the really (really) bad guy.

Ben Zimmer runs the web site Visual Thesaurus , which maps words and their relationships to each other. On Friday's Morning Edition, he talks with host Mary Louise Kelly about the special vocabulary that's arisen from Harry Potter books and films — the last of which, Harry Potter And The Deathly Hallows Part 2, opens this weekend. He compiled this quick guide to Potterisms.

1. Muggles and other blood types

Muggle is the Potterism that has crossed over the most into everyday usage (it even has an entry in the Oxford English Dictionary). From the original meaning, "a person who possesses no magical powers," it's been extended to mean "a person who lacks particular skills" — for instance, used by computer hackers to describe non-hackers. You can also call someone who doesn't understand you or annoys you a muggle .

Beyond muggle , some similar terms from the Harry Potter universe are pureblood (a magical person with no Muggle blood), squib (a non-magical person born into a magical family), mudblood (a magical person born into a Muggle family), and halfblood (a magical person with one Muggle-born parent).

2. Character names

Lord Voldemort: The name of Harry Potter's archenemy can be used to refer to someone supremely diabolical. Since the wizards are afraid of summoning him, he is also known as He Who Must Not Be Named , which comes in handy in everyday life as well to refer to someone who should be kept out of the conversation. (I know a woman who refers to her ex-husband as He Who Must Not Be Named, and her sisters sometimes just call him Voldemort.)

Other character names can be extended to real-life people who share certain key characteristics with their Potter equivalents. So a Dumbledore is a wise and courageous mentor, a Snape is a cruel teacher, a Hermione is a bright young overachiever, and a Draco is an evil bully.

3. Spells and other magic

On Harry Potter message boards, fans admit that they sometimes try out the incantations from the Harry Potter books in the hopes that they'll work in real life. For instance, Accio! (ACK-ee-oh) is the "summoning charm," which could be said if you're too lazy to reach for something. Expecto Patronum! is the spell that conjures your soul's protector ( Patronus ), an incarnation of your positive feelings that wards off dementors (see below). These Latin imperatives are best said in a crisp British accent.

Apparition is a form of teleportation: a magical person can disapparate (disappear) from one place and apparate (reappear) elsewhere. Harry Potter fans often wish they could apparate in real life, though they would need to avoid splinching (becoming physically split between a former location and a new one).

Other magical terms include horcrux (an item of dark magic that holds a piece of soul, used to attain immortality). There are also many magical creatures, like thestrals (winged horses that appear to those who have witnessed death), boggarts (shape-shifters that take on the form of the victim's worst fear), and dementors (soul-sucking fiends). A Harry Potter fan might feel beset by such creatures (metaphorically speaking!).

Phrases from the books and movies seep into the conversation of Harry Potter fans. They might say "Merlin's beard!" or "Gulping gargoyles!" when surprised. " Send me an owl" is a request for communication, since owls deliver messages in the Potter universe, such as invitations to attend Hogwarts, the magic school. If you're anticipating an invitation, you could be "waiting for your Hogwarts letter." When being mischievous, two useful phrases are "I solemnly swear I am up to no good" (an incantation used to make a blank parchment turn into the "Marauder's map") and "mischief managed" (said when finished using the Marauder's map). The point system used to reward and punish the Hogwarts Houses also comes in handy, as in "10 points to Gryffindor!" (or "from Gryffindor" for a punishment).

5. Artifacts of the Potter universe

More committed fans may try to bring the Potter universe into real life by importing certain artifacts. They might hold Quidditch matches (one was held last year in Central Park). Or they might exchange recipes for Butterbeer (a popular wizarding beverage).

6. Britishisms

American fans might find themselves repeating the British words and expressions found in the Harry Potter books and movies (though the terms aren't specific to Rowling's work). Some words that are particularly appealing are derogatory epithets ( prat, git, dunderhead ) and rude interjections ( sod off, bloody hell, blimey ). Another Britishism from the series is ickle , a baby-talk form of 'little."

Help on my HP term paper.

So I need to write a paper for my lit class in which we read the HP series. I chose the thesis 'The Power of Friendship in Harry Potter.' However, scrounging through all 7 of the books to find good quotes for this is proving to be somewhat difficult. Any suggestions you guys have would be awesome! Thanks in advance.

P.S. If you know any quotes from LotR that would apply to this it would also be a help.

Introduction

Case: harry potter vs. hari puttar, intellectual property, case analysis, works cited.

Intellectual property rights are generally regarded as the indicator of the democratic society and protected creation, for writers, inventors, playwrights, and other creators felt protected from stealing their ideas, plots, characters, etc. On the other hand, intellectual property law is the double end stick, which stronger companies and intellectual property owners may use against beginners if there is any tiny suspicion for stealing an idea. It should be emphasized that the necessity to protect the intellectual property fully depends on the aims and requirements of the intellectual property owner, and the entire policy of the company on the matters of IP protection. The paper aims to analyze the case of Harry Potter vs. Hari Puttar from the perspective of IP protection. Thus, IP cases and legal reviews will be regarded for defining the righteousness of the legal suit of the WB company against the creators of Hari Puttar. Considering the main values of IP protection, the key concepts of the case should be regarded and analyzed. Because the sues against other authors by Warner Bros. and J.K. Rowling against other writers, accused in the similarity of the names and trademarks are the common thing for the recent several years, these cases will be regarded as examples of Intellectual Property protection and defense. The fact is that the necessity to protect the copyrights originates from the necessity to protect the ideas and creations from plagiarizing, nevertheless, the contemporary cases of IP protection are closely associated with the economic defense of the lot incomes or used as the reasons for scandals, to attract additional attention for the case. Thus, the paper will be also focused on the main issues and aims of the suing: whether it was an attempt to protect the copyrights and the ownership of the name of Harry Potter, or an attempt to share the incomes of the Mirchi Movies studio.

First, there is a strong necessity to analyze the concept and the plot of both movies, and emphasize the personalities of both characters. Originally, the only similarity between the two characters is the age and similarity of names. Nevertheless, the plots of the stories are different, as Hari Puttar is closer to Home Alone by the plot. The fact is that Hari is the spread Hindi name in Bollywood movies, and Puttar is translated like “son”, consequently, this name has the full right for existence. In the light of the fact, that intellectual property commission and court defined that Mirchi Movies – the company, which issued the movie, has the copyright for Hari similarly like Warner Bros. has the rights for Harry. It was stated that the proper spelling of the name is essentially different from the name of Harry Potter, moreover, the Warner Bros. company had been waiting for three years after the issuing of the movie for suing. Consequently, the court decision was definite, and the claim by Warner Bros was rejected. As it is started in Associated Press (2008): “There is absolutely nothing to link ‘Hari Puttar’ with ‘Harry Potter,’” said Munish Puri, chief executive officer of Mumbai-based producer Mirchi Movies. Hari is a common name in India and “Puttar” is Punjabi for son, he stated.”

Originally, it should be emphasized that Mirchi Movies studio argued, that the name of the movie was taken precisely from the theme, which is the basis of the plot. Thus, the storyline, the plot, and the character itself (like the actor, who acted Hari) have nothing in common with a little wizard Harry Potter. As it is emphasized by Halbert (361):

The defendants also alleged the suppression by the plaintiffs or correspondence with the Motion Picture Associated of America Inc. and claimed that the plaintiffs’ contention that there were no posters of Hari Puttar in any theater and the lack of promotion of the film was false and a cover-up for the plaintiffs’ in action during the period 2006 to 2008. Having come to know of the project in 2006, the plaintiffs took no action till September 2008 when the movie was ready for its release.

It has been already emphasized that the origin of the plot is not similar to the story of a wizard boy, as Hari Puttar’s movie tells the story f an Indian boy, who was eventually left at home in Britain, while his family has moved. From the perspective of the copyright and the Intellectual property protection laws, the idea of Hari Puttar movie is not a violation of the intellectual property, which belongs to J.K. Rowling and Warner bros. Studio.

The producers of the Hari Puttar movie has also emphasized that they were not aiming to make a movie of a wizard boy – a student of a school of magicians, as this plot is not common for Indian culture, and it would not be accepted by the Indian audience., Consequently, the movie is not even an adoption for the western audience, and was released mainly for the Bollywood audience, with slight orientation for abroad watchers.

To begin with, the essence and the definition of Intellectual Property should be given. Thus, as it is emphasized by Myers (8):

Intellectual property (IP) is a term referring to several distinct types of legal monopolies over creations of the mind, both artistic and commercial, and the corresponding fields of law. Under intellectual property law, owners are granted certain exclusive rights to a variety of intangible assets, such as musical, literary, and artistic works; discoveries and inventions; and words, phrases, symbols, and designs. Common types of intellectual property include copyrights, trademarks, patents, industrial design rights, and trade secrets in some jurisdictions.

In the light of this perspective, the main idea of the IP legislation is the protection of a specific expression of an idea. Thus, for instance, while the idea of Superman is protected, the idea of a flying superhero is not, and the IP law guarantees the right to talk about him, parody him and even create other super heroes. The only restriction here is the name, while the concept stays the same, and is open for use. Under Kranch (349), it should be emphasized that the representation of an idea, which is protected by copyright, is the main necessity, which is pursued by the lobbyists of the Intellectual property. Nevertheless, those, who wish to be protected, often mix up the concepts of the idea, and the idea representation. The fact is that the main concept of protection is linked with the precise name of the physical representations. Thus, while Superman is protected by copyright, his suit, the ability to fly, having X-ray vision, etc is not protected like the entire idea of a superhero. Thus, as Lerner (257) has emphasized:

In practice, the line between an idea and its expression can be a hard one to draw. Protecting intellectual property is always a kind of tightrope walk between competing interests. On one side is society’s need for the widest possible dissemination of ideas and facts — indeed, all forms of knowledge. The First Amendment seems to guarantee the right to talk about Superman, parody him, and even, perhaps, base a television series on the concept of a bumbling superhero

In the light of this consideration, it should be emphasized that even if Mirchi Movies had created the movie of a magician boy, it would not be a violation of the Intellectual Property rights, belonging to Warner Bros, and Joanne Rowling, is the idea itself is handing in the air, nevertheless, the name of the character, his background, the names of his friends and magic items, which he uses, are copyrighted, and protected with the IP laws. Moreover, the essence of copyright and IP protection may be often used against young authors and writers. Thus, any young author may send the script to a movie studio and finds that his or her idea is rejected. After some time has passed, the author finds that the idea is accepted, nevertheless, it has been worked through creatively, so, the initial variant is lightly recognizable. The sues are useless, as the main concept has not been stolen (the expression of an idea), while the ideas are not protected by copyright.

By the Intellectual property considerations, the authors, creators, scriptwriters have an opportunity to create something similar to the original idea, nevertheless, precise copying is forbidden. Considering the case of Superman, only his name is protected, while his features and even clothes are not. On the one hand, it gives freedom for the creators of other superheroes, nevertheless, any superhero, which will be in the red and blue suit will inevitably remind Superman. Consequently, the concept of idea protection should be rearranged, for excluding too close similarities. Following the philosophy of Intellectual property protection, emphasized by Fawcett and Torremans (190):

The contemporary, market-driven copyright system provides authors with independent financing (through royalties). Without a feasible way to recoup investments of creative time through copyright, there would be a little economic incentive to produce and works would need to be motivated by a desire for fame from already affluent authors or those able to obtain patronage. Proponents of a copyright dispute that copyright erodes precepts for creators to be able to build on published expression pointing to concepts such as Scènes à Faire and Idea-expression divide.

Nevertheless, the essence of the Consequentialist theory claims that the main aim of the Intellectual Property legislation is to improve the life of the society, by protecting the results of the intellectual work from staling, extensive borrowing, and unconcealed plagiarizing. On the other hand, some scholars (Fawcett and Torremans, 185) emphasize that the main aim of the IP legislation is to protect the incomes of any creator, as authors, musicians, sculptors, etc often get the income from selling the results of their creation, and when someone else borrows the idea or part of its expression, he or she steals some part of the income, thus, decreasing the total income, belonging to the author of the original idea.

As for the matters of Intellectual property in movies, it should be emphasized that the original value of the IP concept here is the protection of the audience from the repeating plot and the cloned characters. Surely, companies protect their incomes in the first turn, and then the interests of the audience. Consequently, if some suspicious similarity is found in a movie, the company would first think over the expenses for the suing, and then will consider the interests of the audience.

The fashion for copyright protection and intellectual property originated in 1967 when the WIPO (World Intellectual Property Organization) was founded. The term itself points out the necessity of protecting the copyrights, patents, and trademarks similarly with the ownership rights of the physical objects. Nevertheless, the origin of a copyright is different from the origin of the physical object ownership law. Thus, if someone has a car, he or she will not allow anyone to drive it, or at least sit at the driving wheel. Nevertheless, the owner of copyright will gladly allow millions to read his or her book, or watch a movie. The same is with the violations. Followers of the intellectual property protection implementation claim that stealing of an idea or text is not acceptable like stealing a car, their opponents claim, that if there was a possibility to copy and paste a car, they would do it, so, the owner and the “thief” would stay with a car. Surely, this sounds strange, nevertheless, it is a common view on the matters of copyright, and Intellectual Property protection. The only solution to this paradox is the implementation of an originally different concept of IP ownership, as it can not be similar to the concept of physical ownership.

Copyrights, from the ethical point of view, are often regarded as the necessary opportunity of an individual to control their lives. Thus, one of the aims of Intellectual Property protection is to create and maintain the moral basis of living. Nevertheless, the main concept of Intellectual Property rights fails to do this. As it is emphasized by Dimock (105):

To enforce copyright laws and the like is to prevent people from making peaceful use of the information they possess. If you have acquired the information legitimately, then on what grounds can you be prevented from using it? The restrictions are originated from IP laws, which restrict the personal freedoms of people, who purchase a book. It may be objected that the person who originated the information deserves ownership rights over it. But information is not a concrete thing an individual can control; it is universal, existing in other people’s minds and other people’s property, and over these, the originator has no legitimate sovereignty.

In the light of this perspective, any copying is forbidden. If people memorize any poem or novel, they store it in their brains, therefore, people have a granted law to memorize everything they wish. Though, if someone wishes to transcribe a poem on a paper sheet, owning a sheet and the sufficient amount of inks, it may be regarded as a violation of the copyright. Surely, if this sheet will be eliminated, no one will be able to sue for the violation of the copyright. On the other hand, if the sheet with a copyrighted poem will be sold, or even presented, this will be regarded as a violation of Intellectual Property rights.

Finally, it should be emphasized that the original term of Intellectual Property originates the simplistic thinking, associated with understanding the essence of the term. Under Dimock (87) the term makes people focus on the issues of meager commonality in the form of disparate laws. Thus, the IP laws create artificial privileges for restricted communities, as these laws impose specific restrictions on the general public, and the simplistic origin of understanding the term of intellectual property is closely associated with the matters of the economic approach to the entire principle of IP protection. Moreover, as was emphasized by Burshtein (204)

For many citizens, Intellectual Property is an obscure and distant domain – its laws shrouded in jargon and technical mystery, its applications relevant only to a specialist audience. And yet Intellectual Property is everywhere. Against the backdrop of the increasing importance of ideas, IP Rights, which protect their value, are more vital than ever.

As it is emphasized in the case studies, J.K. Rowling and Warner Bros. Studio are passionate users of the Intellectual Property laws, and the values of the intellectual property rights, which are represented in this case appear to be rather aggressive. Originally, Hari Puttar is one of the numerous targets, as J.K. Rowling and Warner Bros targeted numerous authors and creators. Thus, in 2008 Rowling sued Steve Vander Ark for issuing The Harry Potter Lexicon. It was a reference book, based on the materials of a fan site.

The story of Barry Trotter was a bestseller in 2003. Originally, the plot, the names, and characters of the proponents were similar to the original Rowling’s creation. The Belorussian author created the story of grenade-launcher – Porri Gatter. Russian audience had an opportunity to enjoy the adventures of Tanya Grotter – which was called the cultural competition with the originals. Moreover, non-for-profit fan fiction is not encouraged either. Surely, these are the matters, which may be decided only by the owners of the Harry Potter names and trademarks, nevertheless, as it has been stated, the idea itself can not be protected, as well as the features of the characters. Thus, neither Porri Gatter nor Tanya Grotter may be sued from legal or ethical points of view.

Considering these issues, and getting back to Hari Puttar, the very instance of suing against the creators of the different stories signifies the inadequate understanding of the Intellectual property concept. Surely, the necessity to protect the results of the creation is necessary, nevertheless, the idea of a wizard boy is obvious, and was present in literature before the creation of Harry Potter. As for the plot, the creators of Hari Puttar have used recognizable themes, as it is common for the products, created for a wide audience. Thus, the name of the main character is similar to Harry Potter, the plot reminds “Home Alone” movie, while the full name of the film (The Comedy of Terrors) is taken from Shakespeare’s The Comedy of Errors. Therefore, while Shakespeare’s names and titles are the public domains, the idea of the plot belongs to nobody, and the essence of the name has been already discovered. Consequently, it is not a copy of Rowling’s work, and the sue is not legal. Moreover, it is the undeserved criticism of the movie.

Analyzing the case, it should be emphasized that Hari Puttar was subjected to such criticism and sue due to the only fact: the creators of this movie had an excellent opportunity to collect the immense box-office, as it is the largest project, among all the regarded projects and creations, which were sued by Rowling or Warner Bros. Studio, while this movie has fewer similarities with Harry Potter than any other project.

The fact is that economic issues ruled the case of Hari Puttar vs. Harry Potter. Originally, the case included all the necessary assumptions on the matters of the amount and production issued under the brand of Harry Potter. Nevertheless, the court has stated that there was no similarity, and the audience could easily differentiate the names of these two characters.

The very problem of the case, and the issues of Intellectual property, associated with it, is the fact, that the laws are becoming invisible. As it was emphasized by Long (135):

The issues of law invisibility arise from the specifics of each law—precisely what the term “intellectual property” encourages people to ignore. For instance, one issue relating to copyright law is whether music sharing should be allowed; patent law has nothing to do with this. Patent law raises issues such as whether poor countries should be allowed to produce life-saving drugs and sell them cheaply to save lives; copyright law has nothing to do with such matters.

Nevertheless, while music sharing is a matter of friendly relations and communication, stealing an idea for commercial use is a quite different thing. Again, the IP legislation slides to a different case, while the main problem stays unresolved. Surely, the lack or absence of intellectual property protection, the very essence of the free creation will be weakened, and the matters of the incomes, originated by selling the initial idea will be violated. Nevertheless, ideas are regarded as the most important input for research and creative activity, thus, if the opportunities for using ideas will be restricted, it would slow down any type of development and research.

In the light of the fact, that the use of the ideas is not originally restricted, nevertheless, the Intellectual property owners often sue against other writers, developers, creators, etc for using their ideas, it should be emphasized that the owners themselves violate the laws, which were claimed to defend their rights. Thus, while Warner Bros. and Joanne Rowling sue against the creators of Hari Puttar, the necessity to protect the ideas, originated by the Mirchi Movies is not considered. The fact is that some of the ideas were original, nevertheless, some of them were further used by Warner Bros in their movies. That will not be taken for granted by the company, therefore, the IP belonging to Mirchi Movies appears to be unprotected. In the light of this fact, it should be emphasized that the necessity to protect the intellectual property of the weaker participants of the IP market should be granted by the WIPO, while the courts regard the cases of the giants like Warner Bros. studio against private writers and smaller studios. (Posey, Dutfield, 89)

Considering the necessity to analyze the aims and values, which were pursued by J.K. Rowling and Warner Bros. studio, it should be emphasized that the original values of the suing are closely associated with the reputation of these two Intellectual Property owners. On the one hand, they aim to protect the results of their work and prevent their works from plagiarizing, on the other hand, the case with Hari Puttar reminds an attempt to originate a scandal, as the other attempts appeared to be useless (Barry Trotter, Porri Gatter and Tanya Grotter). Considering the scales of the Hari Puttar project, the suing by Warner Bros against Mirchi Movies reminds the attempt of preventing losses from renting the movie globally, while the movie is mainly oriented for the Indian audience, and the story of a wizard boy is odd for the Indian culture. (Myers, 67)

The Intellectual Property protection perspective originates the necessity to rearrange the entire principle and structure of the protected premises. Originally, the protection of the Intellectual Property concept is very close to the concept of protecting the ownership of physical property, and the case of Hari Puttar vs. Harry Potter signifies this issue. The fact, that the court has decided in favor of Mirchi Movies studio, signifies that the necessary steps for understanding the concept have been already performed, and the future of Intellectual Property protection is open for further development.

Finally, there is a strong necessity to emphasize that the concept of IP protection and defense is close to the matters of defending the results of creation from plagiarism and extensive borrowing. While borrowing itself is inevitable, as numerous ideas are just hanging in the air, the copyrights aim to protect the names, the patents, and the trademarks. Thus, considering the case of Hari Puttar vs. Harry Potter, it should be stated that the case reminds an attempt to discourage any fan fiction, even even though Hari and Harry have nothing in common.

The aim of the analysis was also to consider, whether the sue was legislated, and whether Warner Bros and Joanne Rowling were protecting their copyrights. Surely, they were unpleasantly surprised by the similarity of the names of the main characters, nevertheless, the origins of these names are different, while the backgrounds and plots are different as chalk from cheese. Thus, the attempt to sue signifies either the improper study of the media market, along with poor knowledge of the Indian culture, or it was the direct attempt to originate a scandal and prevent the possible losses from selling the Hari Puttar movie. Nevertheless, the decision of the court was definite, and taken in favor of the Mirchi Movies studio, as the audience can easily differentiate the names of the little wizard and an Indian boy, who was left alone.

Leadership is typically defined as a particular trait that an individual has that inspires and motivates individuals to be effective in their lives. Specifically, effective leaders are those who not only build and coach a team, but assist in helping individuals effectually set priorities and achieve their goals. The concept of leadership is often reasoned to be both a skill that can be practiced, and a particular area of operation in business that can be thoroughly and extensively researched. Books and films have frequently showcased the concept of leadership with the hope of conveying a unique message to audiences about the captivating power that these individuals, who exhibit these traits, have. One such film series in the Harry Potter series. The series, which is eight films in total, is based on the series that was written by J.K. Rowling. The story follows that of an orphan, named Harry, who discovers that he is a wizard, and through a series of experiences finds himself at a school identified as Hogwarts School of Witchcraft and Wizardry. This school assists him becoming the individual he is meant to be through his interactions with many different people. Two of the individuals that Harry comes in contact with are leaders - Professor Album Dumbledore, who is the headmaster of the school; and Minerva McGonagall, the headmistress at the school. This paper discusses their leadership qualities in substantial detail.

Dumbledore and Leadership

In a discussion on Harry Potter, writer Rob Jenkins, identifies that a good leader is someone who can provide substantial insights and be a great individual at the same time. These traits are exhibited in Dumbledore. Jenkins writes that good leadership requires a trustworthiness by the people and that Dumbledore effectively and consistently shows this. One such instance is his treatment of the gamekeeper at the school. In particular, "Dumbledore hired [him] after he was expelled from the school for something he didn't do" (1). It could be argued that most people would not do such a thing for fear of retaliation or revenge, but Dumbledore viewed Hagrid as someone who could offer wisdom to the students regardless of his past. Leaders have a remarkable capability of leading and recognizing the good attributes in others and persuading them to use these characteristics in an appropriate manner. Hagrid is not the only character that Dumbledore trusts in the film series. Another is Snape, who is the master of potions. Despite the alignment that Snape has with the dark wizard, Lord Voldemort, Dumbledore seems to overlook this and wholeheartedly believes in the good that Snape has brought to the students and to the school. He utilizes participative leadership with Snape in order to not only involve him in the subject matter that he is teaching the students, but to ensure that Snape understands that he has control over him, despite the sly maneuvering that Snape executes. Essentially, Dumbledore is not oblivious to Snape's escapades with Voldemort, but he has opted to overlook them seeing the larger picture. The bigger or larger picture is a concept that leaders usually operate under. They do not allow themselves to get proverbially bogged down with the daily minutiae or chaos - but rather see the end. This is to a certain extent, what makes a leader, a leader. It is not that they are overlooking the issues and problems that may come through goal achievement, but rather they consider that in the grand scheme of things – that such problems will ultimately be mitigated and work toward the good of all in the end. Rob Jenkins states that "it's worth noting that Dumbledore is right to trust both Hagrid and Snape, and that in the end, his faith in them is repaid many times over" (1). It can be said that because leaders tend to see the good and bad in people, yet gravitate more toward the good that they often bestow their trust with an emotional intelligence that all will end up working out. The concept of emotional intelligence is a capability of appropriately observing the emotions of others, as well as those within said individual. As such, Dumbledore understands his emotions, and because of this, is also able to see the extent of how the emotions of others drive them to do what they do. This is why it is easy for him to accept Hagrid and Snape for who and what they are. Jenkins goes on to state that Dumbledore reveals his leadership qualities in the other staff also. Each of the individuals is able to effectively perform the tasks related to their jobs. He does not meddle but rather chooses to have a great deal of confidence in the individuals he has hired (1). This presents an ethical side to the leadership of Dumbledore. Ethical leadership, by and large, deals with the operation of a leader who comprehends and has respect for the beliefs and values of others. To this end, these leaders know their value, and the value of the people that they lead. There is minimal mistrust, ultimately, between the leader and his or her subordinates.

Minerva McGonagall and Leadership

Good and great leaders take pride in being committed and dedicated to those that they are afforded the chance to lead. They recognize the need to do this in order to make an impact. Additionally, they know that this will usually allow them to both monitor the objectives of their subordinates, and receive feedback when necessary. In essence, the professor extensively knows that she will receive feedback from the students and the staff if what she is doing is not necessarily the correct or right thing, while simultaneously monitoring their goals. For Harry, the professor is able to carry out his students, understanding that the professor will seek him out to correct or adjust where he is going wrong. In order to be both a good and effective leader, these individuals must be willing to correct those that they are responsible for. This should be an evident trait or characteristic in the leader. These individuals understand that those who they are responsible for will undoubtedly make mistakes because they don't necessarily know the best way to perform a particular task or duty. As such, the leaders have to be the bigger individual and give feedback to those they are responsible for so that these individuals correct their mistakes - and do not make the same mistakes a second time. Another interesting attribute of Professor McGonagall is her uncanny ability to empower the students to immerse themselves in certain activities. In the film series, one of the sports that is played at the school is Quidditch. McGonagall is able to get Harry and his friends, Ron and Hermione, along with other students interested in playing and participating in the game. Leaders have a specific capability to bring out the best in others. This is why it is almost as easy as breathing and eating for McGonagall to empower Harry and others to play Quidditch, among other things. She, in other words, is a facilitator in the process of them becoming who they are meant to be. Leaders have this capacity with them that allows for a considerable depth to be drawn out of others. They push and prod others to be the best that they can be – often seeing skills, talents and characteristics in others that those individuals simply do not see or observe. McGonagall in getting Harry and his friends to try out Quiddith, forces them out of their comfort zones and into discovering not only what they love, but coming to truly recognize what they do not like as opposed to just not wanting to do something for the sake of it. It is critical for leaders to know when to force and when to take a step back.

While Harry Potter is not the only film to provide stellar examples of leadership in action through the characters of Dumbledore and McGonagall, the series does offer a unique perspective into the trait. Moreover, the film series affords a substantive discussion on the topic of leadership and its relevance to not only the business world, but in everyday life also.

Harry Potter star Afshan Azad shares happy baby news on special anniversary

harry potter term paper

The Potterdom has grown by one more fan as Harry Potter star Afshan Azad has welcomed her second child into the world.

Afshan, who played Padma Patil in the movies and is also mum to three-year-old Kyra, announced the arrival of her daughter on Monday.

Sharing a photo of the newborn wearing a cute lemon-print onesie, Afshan said the baby’s arrival had ‘competed her little family’ and that she felt ‘beyond blessed.’

‘By the Grace of God, on the 08.08, our perfect baby girl came into this world and completed our little family,’ Afshan wrote. ‘I feel beyond blessed to give my Kyra a little sister and a best friend for life - something I could’ve only dreamt of.’

She added that she’s ‘clearly destined to be a girl mom forever’ before telling her followers that she’ll be taking some ‘well needed time off’ to recover and ‘soak up every single newborn baby deliciousness'.

Sweetly, the little one's arrival came just days before Afshan and her husband celebrated a special anniversary. '6 years later... 2 beautiful baby girls.. and a heart and home full of love,' she wrote next to a wedding snap.

Afshan later shared another photo explaining that she and Nabil don't count 12 August as their official wedding anniversary as they had their Islamic Nikkah ceremony the previous October but that they still feel nostalgic when the day rolls around.

Several of Afshan's Harry Potter co-stars sent their love after seeing her baby news including Jessie Cave, who played Lavendar Brown, and Scarlett Hefner, who played Pansy Parkinson.

Afshan's daughter's arrival comes five weeks after she caught up with Rupert Grint, who played Ron Weasley in the film series.

'Padma & Ron reunited after 20+ years. Oh how parenthood has changed us all. ps He’s still not asked me to dance,' she said at the time alongside a throwback snap to the film.

A nother fan equated one Harry Potter character to his support of the Cyclones. “My main man Cedric Diggory, he gave his life for that team,” he said. “[A lot] of loyalty with Hufflepuff right, and I think that’s a characteristic I look for.”
