Steward Health Care under federal investigation for fraud and corruption, sources tell CBS News

CBS News has learned federal authorities in Boston have opened a criminal investigation into Steward Health Care, a company that owns dozens of hospitals nationwide, including nine in Massachusetts, according to two people familiar with the matter. Steward, which is based in Dallas, recently filed for bankruptcy .

Federal prosecutors at the U.S. Attorney's office in Boston are investigating Steward Health Care based on various allegations including fraud and violations of the Foreign Corrupt Practices Act, two people familiar with the matter said. The law prohibits U.S. citizens and entities from engaging in corrupt activities when operating overseas.

In addition to its U.S. properties, Steward was tapped by the government in Malta to run three state-owned hospitals. That deal is now at the center of a criminal corruption probe  playing out in the island nation. Neither Steward nor its executives have been charged in connection to the matter in Malta. 

The Department of Justice did not immediately respond to CBS News' request for comment. 

Reached Thursday, a spokesperson for Steward had no comment. 

Steward filed for bankruptcy reorganization in May and is exploring plans to sell all of its hospitals. Bids for the Massachusetts facilities, which have remained opened during the bankruptcy, are due on Monday. 

Sen. Edward J. Markey, a Democrat from Massachusetts, issued a statement Thursday calling Steward "just the latest example of corporate greed endangering our health system."

"Steward must be investigated, and I hope the company and the corporate executives who facilitated Steward's actions face consequences that reflect the lives, livelihoods, safety, and security that they stole from communities," he said.

The company has been a focus of a year-and-a-half-long CBS News investigation  documenting how private equity and other investor groups have siphoned hundreds of millions of dollars from community hospitals with devastating public health consequences . 

Records reviewed by CBS News showed Steward hospitals around the country left a trail of unpaid bills, at times risking a shortage of potentially life-saving supplies.

The Department of Health in Massachusetts opened an investigation after a woman died after giving birth at a Steward hospital in Boston last October. A complaint made by healthcare workers at the facility, obtained by CBS News, indicates a medical device that might have saved her life had been repossessed by the manufacturer weeks earlier because Steward owed about $2.5 million in unpaid bills.

Steward has become synonymous with the perils of private equity investment in health care. The company started buying up Massachusetts hospitals in 2010, with hundreds of millions of dollars in backing from private equity giant Cerberus .

Cerberus shed its stake in Steward by January 2021, after making an $800 million profit in a decade, according to a report from Bloomberg . Financial records show Steward has also sold off more than $1 billion of its hospitals' land and buildings since 2016 to Medical Properties Trust, which has made a business of buying up hospital real estate from private equity investors. 

A filing with the Securities and Exchange Commission from 2021 shows Steward's owners also paid themselves millions in dividends. Around the same time, Steward CEO Ralph de la Torre acquired a 190-foot yacht estimated to be worth $40 million. 

"They've taken money away from these hospitals that provide needed care and they're using that money to line their own pockets." Massachusetts Gov. Maura Healey told CBS News in February. "I'm disgusted. It's selfish. It's greed."

The company previously told CBS News that executives always put patients first and said they "deny that any other considerations were placed ahead of that guiding principle." The company spokesperson said Steward "has actively and meaningfully invested" in its hospital system since its formation, including in Massachusetts, where it took over hospitals that were "failing" and "about to close."

"Steward Health Care has done everything in its power to operate successfully in a highly challenging health care environment," de la Torre said in a company statement in May.

In the first article in this series , I mentioned the threat of shortages of both physicians and nurses in the industry, even as more people than ever need care. Healthcare organizations will also have an increasing number of management roles to fill over the next decade: employment of medical and health services managers is projected to grow 28% from 2022 to 2032, much faster than the average for all occupations (3%), according to the U.S. Bureau of Labor Statistics .

With so much competition for talent, leaders need to know how to retain employees. As I mentioned last time, personalization is shaping healthcare's future , but healthcare leaders have not been trained to practice personalization. (Read about what RBC Capital Markets calls “ The Individual Revolution .”) This trend applies not just to our patients, who want personalized care, but also to our employees, who want more control over their own careers.

People know they can no longer count on an employer for their long-term financial sustainability through their working years and retirement, so individual loyalty is to their own career rather than to any one employer. As a result, according to the RBC Capital Markets report, linked above, workers are “demanding more control over their careers, the work they are doing, when they work, and the environment in which they work.”

Feidt agreed that there’s room for improvement within organizations when it comes to providing a more individualized experience for employees. “We've come a long way with our patients on that individualism road, at least in my experience. But the employee experience is an area where we definitely have opportunity” to do more.

Listen to Employees

To lead with personalization, you have to practice the art and skill of listening to people.

“We need to listen to our employees,” she said. “I know many organizations carry out employee engagement or experience surveys. When you do those, you should be listening to the results. You should be telling your employees what those results were. And you should be talking to them about how you're going to make a positive impact on those results, and follow up.”

She shared an example of how we can listen to employees in order to take a more personalized approach.

“We have so many diverse age groups in our workforce right now that we really need to be thinking about [how to tailor employee benefits.] Maybe, at this point in my career, I don't need certain resources anymore, but maybe I want pet care insurance or long-term care resources. Is there a way we can offer á la carte, different things that we can offer to enhance our employee experience?”

Seek Input from Younger, Emerging Leaders

Since we have multigenerational workplaces in healthcare, I asked Feidt to share advice for how we can navigate and perhaps benefit from those differences in thought. She suggested that we take advantage of the fresh perspectives they bring to the organization.

“I would say to emerging leaders: be courageous, be brave, and speak up. Anytime we onboard a new employee, I've always told them to please share new ideas, fresh ideas. Because we get stuck in ruts of standardization, where we've been doing things for years and we don't know why until a new employee comes in and asks, why do we do this?”

And for those of us who’ve been around for a while and might be stuck in those old ways, we need to be open to the questions and the new perspectives.

“We have to constantly be asking ourselves why [we do things a certain way]. Does it make a meaningful difference to our patients’ families or to our employees or our communities? Because if it doesn't, let's get rid of it.”

She shared one way to think about it.

“I recently heard this word: GROSS— get rid of stupid stuff —and it just really stuck with me. As we try to move from standardization to more personalization, what really adds value?”

Get rid of everything else.

But there are obstacles, and sometimes one of those obstacles is us. Recently I was training emerging leaders and I said to the group, “I bet you have felt suppressed over the years, and you've given up challenging the status quo because you realized that you weren't getting anywhere, even though you made all the efforts to help the organization do what's right.” There was silence in the room until someone said, “How did you know that?”

I see it all the time.

Feidt agreed.

“Sometimes we look at what our employees bring to the table not as an opportunity for growth and better outcomes, but we see it as a threat. I've run into that and I've been in that place myself. That’s not okay. Inclusivity includes being listened to, heard, and valued. We have to open our minds and change the way we operate our cultures and organizations and mindsets as healthcare leaders.”

Over the past several years I’ve started to understand why we often have trouble listening to each other. It's because for so many years we were listening to sameness, and now we're listening to difference. This requires a new mindset.

Harnessing the Power of Pharmacists in eCQM Programs for Better Patient Care

Pharmacists are unsung heroes in the healthcare industry, playing a crucial role in ensuring medication safety and effectiveness. With the rise of Electronic Clinical Quality Measures (eCQMs), pharmacists have a unique opportunity to showcase their expertise and make a significant impact on patient outcomes.

The Value of Pharmacists in eCQM Programs

Pharmacists possess a wealth of knowledge in pharmacology, drug interactions, and patient care, making them indispensable members of the healthcare team. Their meticulous monitoring of medication regimens, swift identification and resolution of medication-related problems, and dedication to patient education contribute significantly to preventing adverse drug reactions, optimizing medication adherence, and improving overall patient outcomes. By actively participating in eCQM programs, pharmacists can leverage quantifiable metrics to demonstrate their expertise and the positive impact they have on patient care. This is becoming even more valuable as many of the eCQMs are involving medications data capture.

Innovative Strategies for Pharmacist Engagement

To effectively engage pharmacists in eCQM programs, it is crucial to provide them with educational opportunities and training sessions. These sessions should cover topics such as eCQM measures, data collection and analysis, and quality improvement strategies. Ongoing training and support should also be provided to keep pharmacists up-to-date on the latest eCQM requirements and best practices. Collaborative partnerships between pharmacists, physicians, and quality teams are essential for successful eCQM implementation. By working together, pharmacists can identify gaps in patient care, develop targeted interventions, and implement evidence-based practices to optimize medication management strategies.

Recognizing Pharmacists' Contributions

Pharmacists deserve recognition for their invaluable contributions to eCQM programs and their efforts to improve the quality of care for patients. Encouraging pharmacists to participate in eCQM research and quality improvement initiatives is crucial. They can contribute to the development and validation of eCQM measures, conduct research studies on the impact of eCQMs on patient care, and actively participate in initiatives aimed at improving the quality of care. By acknowledging and appreciating their contributions, healthcare organizations can further motivate pharmacists to actively engage in eCQM programs.

Overcoming Barriers to Adoption

Despite the potential benefits of eCQMs, there are barriers to pharmacist adoption that need to be addressed. Many pharmacists may not fully understand the value of eCQMs and how they can enhance patient care. To overcome this, healthcare organizations should focus on educating pharmacists about the benefits of eCQMs through workshops, webinars, and other educational programs. Additionally, providing pharmacists with the necessary resources, such as access to technology, data, and support staff, is crucial for their active participation. Creating a culture of change within healthcare organizations is also important, encouraging pharmacists to embrace new technologies and practices while addressing their concerns about workflow impact.

I recently worked with a client whose performance rates were well below average. For over two years, we tried changing documentation, working with providers, and looking for ways to capture the data elements needed to improve their rates. But performance rates did not improve. After some discussion, the Quality Director decided to get Pharmacy involved. They began looking at medication administration, order sets, provider compliance, and provider education. They had meetings with the providers to discover gaps and prescribing challenges. Over a period of one month, their performance rates improved by 25% across all measures. They now have a pharmacist that watches for fallouts for these measures on a weekly basis to monitor stability for pharmacological data elements in these measures.

Future Directions for Pharmacist Involvement

Pharmacists have a critical role to play in the future of eCQMs. Their expertise in medications positions them well to provide valuable insights into the development and implementation of eCQMs that specifically address medication-related outcomes. Future research should focus on developing eCQMs that measure the impact of medication therapy on patient outcomes, such as reducing medication errors, improving medication adherence, and achieving therapeutic goals. By actively involving pharmacists in the development and implementation of eCQMs, healthcare organizations can ensure that these measures accurately reflect the quality of patient care.

Working in healthcare has its challenges. Providers of all kinds work diligently to provide quality patient care. It is discouraging when performance rates do not reflect the work that is done. The community only sees what is reported publicly. If what is being reported is not accurate, then what the community sees does not reflect the true patient care your facility is providing. All the work that providers put into their daily care of patients is not recognized because of erroneous data capture. Our goal is to work with hospitals to make sure that the data is accurate and accurately reflects the patient care that is being provided.

It takes a team. You probably already have a good group on your team representing IT and Quality. If you have not already, it’s a good move to consider adding Pharmacy to your team to get better results, which will more accurately represent the great patient care you provide to your patients.
